USE OF CRICCHAMPS
CricChamps may, at its sole and absolute discretion:
- Restrict, suspend, or terminate any Users access to all or any part of CricChamps.
- Reject, move, or remove any material that may be submitted by a User.
- Move or remove any content that is available on CricChamps
- Deactivate or delete a Users account and all related information and files on the account.
- Establish general practices and limits concerning use of CricChamps.
- Revise or make additions to the roster of players available for selection in a Contest on account of revisions to the roster of players involved in the relevant Sports Event.
Through the App, the Company offers Users sports-based online fantasy games (Contests).
Users wishing to participate in Games ("Participants") are invited to create their own fantasy teams ("Team/s") consisting of real life sport players (cricketers for cricket) involved in a real-life match, series or tournament (each a Sporting Event) to which the fantasy game relates.
CricChamps offers users fantasy games (Contests) relating to each Sporting Event, and Participants can participate in such game(s) with their Teams. Teams are awarded points on the basis of the real life cricketers performances at the end of a designated match, round or tournament. The Participant(s) whose Team(s) have achieved the highest aggregate score(s) in the Sporting Event(s) shall be declared winners ("Winners").
Currently, CricChamps provides contests for Cricket: A fantasy cricket game. Individual users wishing to participate in the Contests ("Participants") are invited to create their own fantasy teams ("Team/s") consisting of real life cricketers or real life footballers (as applicable) involved in the real-life cricket match (as applicable), series or tournament (each a Sport Event) to which the fantasy game relates. CricChamps offers Participants fantasy game Contest(s) relating to each Sport Event, and Participants can participate in such Contest(s) with their Teams. Teams are awarded points on the basis of the real life cricketers (as applicable) performances at the end of a designated match, round or tournament of the Contest(s). The Participant(s) whose Team(s) have achieved the highest aggregate score(s) in the Contest(s) shall be declared winners ("Winners"). In certain pre-specified Contests, CricChamps may declare more than one Winner and distribute prizes to such Winners in increasing order of their Team's aggregate score at the end of the designated round(s) of the Contests. The Contest(s) across both Cricket Fantasy Games, in addition to the Terms and Conditions, rules and regulations mentioned herein, be governed by: "Fantasy Rules" available at How to Play section.
Free contests: CricChamps offers promotional free contests where no purchase of any goods or services is necessary to play in the contests. All users can play the contest for FREE, and may be eligible to win prizes.
Paid contests: Users may participate in the Contest(s) by paying the pre-designated amount as provided on the relevant Contest page. The Participant with the highest aggregate points at the end of the pre-determined round shall be eligible to win a pre-designated prize, as stated on the relevant Contest(s) page.
Contests are Game of Skills
You acknowledge, agree and confirm that the Games described in section above are games of skill as the success of Participants in such games depends primarily on their relative knowledge of
- The game of cricket
- Cricket statistics
- The performance of players in in a particular territory, conditions and/or format (such as ODIs, test cricket, T20 or T20 Internationals for Cricket sport)
- Attention and dedication towards the Game(s); and Adroitness in playing the Game(s).
The Game(s) also requires Participants to field well-balanced sides with limited resources and, in some cases, make substitutions at appropriate times to gain the maximum points.
Users are required to first assess the relative worth of each sport player in light of the scoring criteria used by CricChamps and make theoretical evaluation of the sport players prospective accumulated statistics over the course of the round at the time of drafting a fantasy team.
Legality of Game of Skill
India: Games of skill are legal, as they are excluded from the ambit of Indian gambling legislations including, the Public Gambling Act of 1867.The Indian Supreme Court in the cases of State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153) has held that a game in which success depends predominantly upon the superior knowledge, training, attention, experience and adroitness of the player shall be classified as a game of skill.
By participating in this Contest(s), each Participant acknowledges and agrees that he/she is participating in a game of skill.
Eligibility of Game of Skill
The Contest(s) are open only to persons above the age of 18 years.
India: CricChamps may, in accordance with the laws prevailing in certain Indian states, bar individuals residing in those states from participating in the Contest(s). Currently, individuals residing in the Indian states of Assam, Orissa and Telangana may not participate in the paid version of the Contest as the laws of these states bar persons from participating in games of skill where participants are required to pay to enter.
Persons who wish to participate must have a valid email address and mobile number.
Only those Participants who have successfully registered on the CricChamps as well as registered prior to each round in accordance with the procedure outlined above shall be eligible to participate in the Contest and win prizes.
No employees from, or contractors working with, CricChamps, nor any of their subsidiaries shall be allowed to contest in playing paid leagues on the platform. Special Accounts operated by employees or contractors may participate in leagues for monitoring purposes, but not in such a way that may affect the results of said event.
Prizes, its distribution and Taxes
Within a reasonable time period after each Game or Sporting Event ends, the tentative Winners are announced but remain subject to final verification by the Company. The Company may, in its sole discretion, award cash or non-cash prizes, to the Winners of each Game or Sporting Event.
In the event of a tie, the prize is divided evenly between the tied players, unless otherwise specified in the Game Guides.
For a summary of prizes for currently open Games or Sporting Events, You may login to the relevant sub-page and check the then-current prize structure prior to the commencement of the Games or Sporting Events. You will be able to see the final Prize Structure only after the Game or Sporting Event has been locked i.e. the Game or Sporting Event has begun.
Prize calculations are based on the results as of the time when final scoring is tabulated by the Company. Once winners are initially announced by the Company, the scoring results will not be changed in light of adjustments made in the official scoreboards, though we reserve the right to make adjustments based on errors or irregularities in the transmission of information to us from our stats provider or in our calculation of results.
All the prizes earned from playing leagues with free entry are non cashable. The user needs to play paid leagues to utilize the prize amount.
In all disputes arising out of the determination of the winner of the Games or Sporting Events, the Company is the sole judge and its actions are final and binding on all Users.
Refund: All fantasy contest payments are final. No refunds will be issued. However, if a fantasy contest is cancelled or does not become operative as the terms of the contest remain unsatisfied, the payments made by you in such contest shall be refunded to your Account.
Disputes: You must notify us in writing within seven (7) days after receiving your credit card or relevant Payment Provider statement, if you dispute any of our charges on that statement or such dispute will be deemed waived
Tax on prizes for Indian users: All prizes shall be subject to deduction of tax (TDS) as per the provisions of the Income Tax Act, 1961. Winners will be provided TDS certificates in respect of such tax deductions. The Winners shall be responsible for payment of any other applicable tax, including but not limited to, income tax, gift tax, etc. in respect of the prize money.
